Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of QuizBunch, operated by Asetral (Asetral Software), an online software brand and publisher with team members working remotely in multiple countries("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree, you must not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Eligibility
You must be at least 13 years old to use the Service, or older if a higher minimum age is required where you live. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
You represent that the information you provide is accurate and that you have the legal capacity to enter into this agreement.
The service
QuizBunch provides casual quiz and party-game experiences in the browser, including but not limited to: This or That, trivia (solo and multiplayer), personality quizzes, Know Me challenges, daily lineups, photo quiz (map and year modes), mash-ups, tournament-style modes (bracket, blind rank, tier list), custom community packs, comments and reactions on packs, party rooms with short join codes, and optional progressive web app (PWA) installation. We may add, change, or remove features at any time.
Some features require you to sign in and use our cloud hosting (accounts, saved quizzes, multiplayer rooms, leaderboards, and Know Me). We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device or browser. Leaderboard scores are submitted on an honor-system basis and may be moderated or removed if we detect abuse. The Service is provided free of charge unless we introduce paid features in the future, in which case additional terms may apply.
The Service may link to other games or websites operated by third parties (for example, GuessBeat.com). Those properties are separate services with their own terms.
Accounts
Creating an account is optional for many features. When you register, you must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.
We may suspend or terminate accounts that violate these Terms, pose security risks, or are inactive for extended periods where permitted by law. You may stop using the Service or request account deletion by contacting contact@quizbunch.com or our Contact form.
User content
You may submit content through the Service, including custom quiz packs, Know Me challenges, display names, room chat messages, answers, comments, reactions, leaderboard entries, and other materials ("User Content"). You retain ownership of your User Content, subject to the license below.
By submitting User Content, you grant Asetral a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, moderate, and otherwise use your User Content solely to operate, promote, and improve the Service. This license ends when your User Content is deleted from our systems, except for reasonable backup copies and where retention is required by law or for dispute resolution.
You represent and warrant that:
- You own or have the necessary rights to submit the User Content;
- Your User Content does not infringe intellectual property, privacy, or other rights of others;
- Your User Content complies with these Terms and applicable law.
Shared links (for example, Know Me challenge URLs, room codes, or pack links) may allow anyone with the link to view or interact with content you publish. Share links only with people you trust.
We are not obligated to host User Content and may remove, restrict, or refuse any User Content at our discretion, including for violations of these Terms, without prior notice.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law;
- Harass, threaten, defame, or harm others;
- Upload or post content that is illegal, obscene, hateful, exploitative, sexually inappropriate, or infringes third-party rights;
- Post spam, scams, or misleading comments or reactions on community packs;
- Impersonate any person or entity or misrepresent your affiliation;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Interfere with the Service, including by scraping, automated abuse, or circumventing rate limits;
- Introduce malware, spam, or harmful code;
- Use the Service to send unsolicited commercial messages;
- Reverse engineer or copy the Service except as permitted by law;
- Manipulate leaderboards, rooms, or votes through cheating or automation.
We may remove content, end sessions, or restrict access that we believe violates these rules.
Moderation and enforcement
We may review, remove, restrict visibility of, or refuse User Content and may suspend or terminate accounts or sessions that violate these Terms, pose security or legal risk, or harm other users. We are not obligated to monitor all content but may act when we become aware of violations.
Repeat infringers or serious violations may lose access to publishing features, community tools, or the Service entirely. Where permitted by law, we may preserve records needed to enforce these Terms or respond to legal requests.
If you believe we made a moderation mistake, contact contact@quizbunch.com or our Contact form with enough detail (including URLs or room codes) and we will review in good faith.
Reporting content
To report User Content you believe is illegal, infringing, abusive, or otherwise violates these Terms, email contact@quizbunch.com or use our Contact form and include:
- The URL or description of the content (pack link, Know Me link, comment, or room code);
- The reason for your report;
- Your contact information, if you want a reply.
We may remove or restrict reported content and take action against accounts where appropriate. We cannot guarantee outcomes or response times for every report, but we treat safety and intellectual property complaints seriously.
Content accuracy
Quiz questions, personality outcomes, trivia answers, photo quiz locations, Wikimedia-sourced images, and User Content are provided for entertainment. We do not warrant that any content is accurate, complete, current, or suitable for any particular purpose. Do not rely on the Service for professional, medical, legal, financial, or safety-critical decisions.
Intellectual property
The Service, including the QuizBunch name, logos, design, software, and built-in quiz content (excluding User Content and third-party media used under license), is owned by Asetral or its licensors and protected by intellectual property laws. Except for the limited rights expressly granted, no license is granted to you.
You may not use our trademarks or branding without prior written permission.
Trivia images from Wikimedia Commons are used under the licenses indicated on each question. Your use of those images is subject to the applicable open-content license terms displayed in the Service.
Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to contact@quizbunch.com with:
- Identification of the copyrighted work;
- Identification of the material claimed to be infringing and its location on the Service;
- Your contact information;
- A statement of good-faith belief that use is not authorized;
- A statement, under penalty of perjury where applicable, that the information is accurate and you are authorized to act;
- Your physical or electronic signature.
We may remove or disable access to material that we believe infringes copyright and may terminate repeat infringers.
Third-party services
The Service integrates with third-party services, including Google (Analytics, AdSense, Firebase, Forms), Formspree (contact form), Vercel (hosting), OpenStreetMap (photo quiz maps), Wikimedia (trivia images), and outbound links to partner sites. Your use of those services may be subject to separate terms and privacy policies. We are not responsible for third-party services.
Advertising and cookies
The Service may display advertisements, including through Google AdSense when you consent to advertising cookies. Ads may be personalized based on your activity. We do not endorse advertisers or their products. Your interactions with advertisers are solely between you and the advertiser. Cookie and analytics choices are described in our Privacy Policy and our on-site cookie preferences control.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASETRAL, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), OR THE EQUIVALENT IN LOCAL CURRENCY.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
Indemnification
You agree to indemnify, defend, and hold harmless Asetral and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.
Governing law
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles that would require application of another jurisdiction's laws. This choice of law applies to the contractual relationship between you and Asetral and does not mean that Asetral maintains a physical office or headquarters in any particular country.
If you are a consumer in a country whose mandatory consumer protection laws give you rights that cannot be waived by contract, those laws apply to the extent required and prevail over conflicting provisions of these Terms, including for claims brought in the courts of your country of residence where mandatory law permits.
Disputes
Before filing a formal claim, you agree to contact us at contact@quizbunch.com or our Contact form and attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved, either party may pursue available legal remedies.
If you are a consumer, you may bring claims in the courts of your country of residence where mandatory local law gives you that right. For other disputes, each party may bring claims in courts of competent jurisdiction in the place where the defendant is located or where harm arose, subject to applicable law.
Asetral may also bring claims against you in any jurisdiction where you reside or use the Service, to the extent permitted by law.
Either party may request non-binding mediation before litigation. Nothing in this section prevents either party from seeking injunctive relief for intellectual property or security violations in any competent court.
Export and sanctions
You may not use the Service if you are located in, or a national of, a country subject to comprehensive sanctions, or if you are on a government denied-party list. You agree to comply with applicable export control and sanctions laws.
Changes to these terms
We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated through the Service. Your continued use after changes become effective constitutes acceptance of the revised Terms where permitted by law.
Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Asetral regarding the Service and supersede prior agreements on the subject.
Our failure to enforce any right or provision is not a waiver of that right or provision.
